This one is about something more immediate.<\/p>\n<p><strong>If you get this wrong, you lose the channel.<\/strong><\/p>\n<p>Not through a legal process. Through Meta&#8217;s quality system, which measures how people react to your messages and restricts your number when enough of them react badly.<\/p>\n<p><strong>Losing WhatsApp access costs more than any campaign gains.<\/strong> That is the practical reason to take consent seriously, quite apart from the legal one.<\/p>\n<h2>What counts as opt-in<\/h2>\n<p><strong>Opt-in must be clear and specific.<\/strong> The person agreed to receive WhatsApp messages from you, and they knew what kind.<\/p>\n<p><strong>Valid:<\/strong><\/p>\n<ul>\n<li>A checkbox at checkout saying they want order updates on WhatsApp<\/li>\n<li>Sending you a message asking to be kept informed<\/li>\n<li>A signed form specifying WhatsApp messaging<\/li>\n<\/ul>\n<p><strong>Not valid:<\/strong><\/p>\n<ul>\n<li>Having your phone number<\/li>\n<li>Buying something once<\/li>\n<li>Handing you a business card<\/li>\n<li>Consent buried in terms and conditions nobody reads<\/li>\n<li>A pre-ticked box<\/li>\n<\/ul>\n<p><strong>The test:<\/strong> could you show somebody exactly when and how this person agreed? If not, you do not have consent.<\/p>\n<div style=\"border:1px solid #e0e0e0;border-radius:6px;padding:18px 20px;margin:24px 0;background:#fafafa\">\n<p style=\"font-size:12px;letter-spacing:.5px;text-transform:uppercase;color:#5C3A52;font-weight:700;margin:0 0 14px\">FIGURE 2: WHAT IS AND IS NOT CONSENT<\/p>\n<div style=\"display:flex;flex-wrap:wrap;gap:14px\">\n<div style=\"flex:1 1 200px;min-width:200px;background:#fff;border:1px solid #e6e6e6;border-radius:5px;padding:14px 16px\">\n<p style=\"margin:0 0 8px;font-weight:700;color:#0F9E96;font-size:14px\">Consent<\/p>\n<ul style=\"margin:0;padding-left:18px;color:#5a5a5a;font-size:13px;line-height:1.6\">\n<li>A checkbox specifying WhatsApp updates<\/li>\n<li>They messaged you first<\/li>\n<li>A form they signed knowing what it meant<\/li>\n<li>Recorded \u2014 when, how, what for<\/li>\n<\/ul>\n<\/div>\n<div style=\"flex:1 1 200px;min-width:200px;background:#fff;border:1px solid #e6e6e6;border-radius:5px;padding:14px 16px\">\n<p style=\"margin:0 0 8px;font-weight:700;color:#B04A4A;font-size:14px\">Not consent<\/p>\n<ul style=\"margin:0;padding-left:18px;color:#5a5a5a;font-size:13px;line-height:1.6\">\n<li>You have their number<\/li>\n<li>They bought something once<\/li>\n<li>A pre-ticked box<\/li>\n<li>Buried in terms nobody read<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<h2>Recording it<\/h2>\n<p>Keep, for every contact:<\/p>\n<ul>\n<li><strong>When<\/strong> they opted in<\/li>\n<li><strong>How<\/strong> \u2014 which form, which page, which conversation<\/li>\n<li><strong>What for<\/strong> \u2014 order updates, or marketing too, or both<\/li>\n<\/ul>\n<p><strong>Two reasons this matters:<\/strong><\/p>\n<p>If you are ever asked, you need to show it.<\/p>\n<p>And more practically: <strong>it prevents a different system from messaging somebody who only agreed to order updates.<\/strong> That is how most accidental violations happen \u2014 not deliberately, but because two systems had different views of what somebody agreed to.<\/p>\n<h2>Opt-out<\/h2>\n<p>Every messaging programme needs a route out that works.<\/p>\n<p><strong>Accept plain language.<\/strong> People will write &#8220;stop&#8221;, &#8220;unsubscribe&#8221;, &#8220;no more&#8221;, &#8220;remove me&#8221;, or just &#8220;please stop messaging me&#8221;. Do not require an exact keyword.<\/p>\n<p><strong>Act immediately.<\/strong> Not at the next sync. If a message goes out after somebody asked you to stop, that is worse than the original problem.<\/p>\n<p><strong>Record it centrally<\/strong>, so every system knows.<\/p>\n<p><strong>Confirm it.<\/strong> One short message saying they have been removed. Then nothing.<\/p>\n<p><strong>Make it easy to find.<\/strong> Hiding the opt-out costs more than the unsubscribes save, because people block instead \u2014 and blocks damage your quality rating far more than unsubscribes do.<\/p>\n<h2>Quality rating<\/h2>\n<p>Meta&#8217;s measure of how people react to your messages.<\/p>\n<p><strong>What lowers it:<\/strong><\/p>\n<ul>\n<li>Blocks<\/li>\n<li>Reports<\/li>\n<li>Messages going unread<\/li>\n<li>High volume to people who did not want it<\/li>\n<\/ul>\n<p><strong>What happens as it falls:<\/strong><\/p>\n<p>Your messaging limits reduce. Fall further and the number can be restricted or disabled.<\/p>\n<p><strong>It is a warning system.<\/strong> It declines before you lose access, which means somebody watching it can act in time.<\/p>\n<p><strong>Check it regularly.<\/strong> Weekly is reasonable. Promotions get reported.<\/li>\n<\/ul>\n<\/div>\n<div style=\"flex:1 1 200px;min-width:200px;background:#fff;border:1px solid #e6e6e6;border-radius:5px;padding:14px 16px\">\n<p style=\"margin:0 0 8px;font-weight:700;color:#5C3A52;font-size:14px\">Immediate, easy opt-out<\/p>\n<ul style=\"margin:0;padding-left:18px;color:#5a5a5a;font-size:13px;line-height:1.6\">\n<li>People who cannot leave easily block instead. Blocks hurt more.<\/li>\n<\/ul>\n<\/div>\n<div style=\"flex:1 1 200px;min-width:200px;background:#fff;border:1px solid #e6e6e6;border-radius:5px;padding:14px 16px\">\n<p style=\"margin:0 0 8px;font-weight:700;color:#5C3A52;font-size:14px\">Somebody watching the rating<\/p>\n<ul style=\"margin:0;padding-left:18px;color:#5a5a5a;font-size:13px;line-height:1.6\">\n<li>It falls before access is lost. That is a warning you can use.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<h2>Separating consent types<\/h2>\n<p>Worth doing properly, because it prevents most problems.<\/p>\n<p><strong>Somebody who agreed to order updates has not agreed to promotions.<\/strong><\/p>\n<p>Treating those as the same thing is how businesses end up sending marketing to people who wanted notifications, getting reported, and damaging the channel that was working.<\/p>\n<p><strong>Keep them as separate flags<\/strong> on the customer record. Two questions at signup, two stored values, and every send checks the right one.<\/p>\n<h2>Legal requirements<\/h2>\n<p>These vary by country and this is not legal advice. But the principles are consistent.<\/p>\n<p><strong>Consent before messaging.<\/strong> Most jurisdictions require it for marketing, and many for any commercial messaging.<\/p>\n<p><strong>Clear identification.<\/strong> The recipient must know who is messaging them.<\/p>\n<p><strong>Working opt-out.<\/strong> Required nearly everywhere.<\/p>\n<p><strong>Data protection.<\/strong> Phone numbers are personal data. Storage, retention and deletion rules apply.<\/p>\n<p><strong>Records.<\/strong> You may need to show consent existed.<\/p>\n<p><strong>Check what applies where you operate<\/strong>, and where your customers are \u2014 the two can differ.<\/p>\n<h2>What actually goes wrong<\/h2>\n<p>Five patterns, in order of frequency.<\/p>\n<p><strong>Sending to a list you already had.<\/strong> Existing customer phone numbers are not opted-in contacts. This is the most common mistake and it damages your rating fastest.<\/p>\n<p><strong>Mixing consent types.<\/strong> Marketing sent to people who agreed to order updates.<\/p>\n<p><strong>Opt-outs not propagating.<\/strong> Somebody unsubscribes in one system and another keeps messaging.<\/p>\n<p><strong>Nobody watching the rating.<\/strong> The warning goes unheard until access is restricted.<\/p>\n<p><strong>Too much, too often.<\/strong> Frequency alone can sink a rating even when every message is technically permitted.<\/p>\n<h2>Getting it right from the start<\/h2>\n<p>Seven things, before the first message.<\/p>\n<ol>\n<li><strong>Add a specific WhatsApp opt-in<\/strong> to your signup and checkout, separate from email<\/li>\n<li><strong>Store consent with a date and a source<\/strong><\/li>\n<li><strong>Keep marketing consent separate<\/strong> from utility consent<\/li>\n<li><strong>Build opt-out handling<\/strong> that accepts plain language and acts immediately<\/li>\n<li><strong>Make sure opt-out reaches every system<\/strong> that might send<\/li>\n<li><strong>Start with utility messages only<\/strong> \u2014 order updates, reminders<\/li>\n<li><strong>Check the quality rating weekly<\/strong> from day one<\/li>\n<\/ol>\n<p><strong>Point 6 is worth emphasising.<\/strong> Starting with utility builds a good rating. Starting with promotion means you are managing a problem from the first week.<\/p>\n<h2>If your rating drops<\/h2>\n<p><strong>Stop sending immediately.<\/strong> Do not push through.<\/p>\n<p><strong>Look at what changed.<\/strong> New message type? Higher volume?
